Question 1: Is your company’s name listed on the DG Environment list of operators or European Commission Prior Compliance List?

The European Commission adopted on August 5, 2009 a list of aircraft operators that have undertaken a relevant aviation activity on or after January 1, 2006, specifying the administering Member State for each aircraft operator.

Operators and their administering countries are listed on 2 lists:

  • List of aircraft operators – published every year in February
  • Prior compliance list – published every year around May

If yes, your company’s operations to EU country airports has already been captured by Eurocontrol records and your company has been assigned to an EU country for ETS administration. Proceed to Step 3 for further instructions.

If no, proceed to question 2.

If no, submit a request to be added to the prior compliance list via e-mail to env-eu-ets-aviation-prior-compliance-list@ec.europa.eu and continue to monitor the release of new prior compliance lists for your operation’s administering member state assignment. The purpose of the prior compliance list is to allocate operators that are currently outside the scope of the scheme, but forecast that they will be covered by Directive 2003/87/EC in 2010 to an administering member state to enable them to participate in the tonne-km and emissions monitoring in 2010. Once a prior compliance list is issued which assigns your operation to an administering member state, proceed to step 3 for further instructions.


Question 3: Did your organization use a flight plan service provider for its flights to European Union Countries between the dates of January 1, 2006 and December 31, 2008?

If yes, there is a good chance that your company’s flight activity was aggregated with other flights handled by your flight plan service provider. The European Commission has established a process to identify those operators whose flights were aggregated with other flights handled by your flight plan service provider. If you know that your aircraft had flights to or from EU country airports between January 1, 2006 and December 31, 2008, you should complete a Fleet List Form and e-mail it to the European Commission at ENV-EU-ETS-AIRCRAFT-OPERATOR-LIST@ec.europa.eu. Follow the instructions provided through the reply of European Commission authorities and proceed to step 3 for further instructions.
